Terms of service

These are the terms for companies, and the people at those companies, who use BlastWiz.

At a glance

  • BlastWiz is for businesses. It is not for personal use.
  • You decide who to contact and what to say. You are responsible for having consent and for following the laws and carrier rules on texting, calling and email.
  • Connecting other services, such as Gmail or your own AI provider account, is your choice.
  • Fees are the ones agreed in your order.
  • The service is provided as is.

1.These terms

BlastWiz is operated by BuiltforMCA.com("BlastWiz", "we", "us"). These terms are an agreement between us and the company that uses BlastWiz ("the customer", "you"). By using BlastWiz you agree to them. If you use BlastWiz for a company, you confirm that you are allowed to accept these terms for that company.

2.Who may use BlastWiz

BlastWiz is a tool for businesses. You may use it only for your business, and only through accounts we or your company's administrator set up. Everyone who uses it must be at least 18 years old.

3.Accounts

Keep sign-in details private. Each person needs their own account. You are responsible for what is done through your company's accounts. Tell us straight away if you think an account has been used by someone who should not have it.

4.Your messages and your compliance

You decide who to contact, what to say and when. That makes you responsible for:

  • Consent. Having the consent the law requires before you text, call or email anyone, and keeping proof of it.
  • The law. Following the laws that apply to your messages and calls. In the United States these include the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, do-not-call rules, call recording laws and state laws.
  • Carrier rules. Following the rules of the phone carriers and of the industry bodies they follow, including registration of your brand and campaigns (10DLC) and their content rules.
  • Opt-outs. Respecting every request to stop. BlastWiz provides tools that help, such as stop lists and opt-out keywords. They do not replace your own duty.
  • Your content. Everything you send or upload, including what the AI Agent writes and sends for you under the settings and instructions you give it.
  • Your data. Having the right to upload the contact lists and other information you put into BlastWiz.

5.Acceptable use

You must not use BlastWiz to:

  • Send messages that are unlawful, deceptive, harassing or fraudulent.
  • Contact people who have asked you to stop.
  • Pretend to be another person or business.
  • Send content that carriers prohibit.
  • Break into, overload or interfere with the service, or get around its limits.
  • Copy, resell or reverse engineer the service.

We may suspend sending, or an account, if we reasonably believe these terms are being broken.

6.Other services

BlastWiz works with services that other companies run. Their own terms apply to them.

  • Carriers. Texts and calls travel over phone carriers. Delivery depends on them, and they can filter or block messages.
  • Your AI provider account.The AI Agent runs on an AI provider account that your company connects, with your company's own key. You are responsible for that account, its cost and its settings, and for your agreement with that provider.
  • Gmail.Connecting a Gmail account is optional and is each rep's own choice. What BlastWiz reads, stores and shares when Gmail is connected is set out in the privacy policy. How to disconnect is on the Gmail help page.
  • Your deal system and other connections. If you connect another system to BlastWiz, you allow BlastWiz to send it the information that connection is for.

7.Fees

Fees are as agreed in the customer's order. Charges from your own providers, such as your AI provider, are yours to pay.

8.Availability

We work to keep BlastWiz running, but we provide it "as is" and "as available". To the extent the law allows, we make no warranties, including that the service will be uninterrupted or free of errors, that messages will be delivered, or that what the AI Agent writes will be accurate. You should review how the AI Agent is set up and what it sends.

9.Limits on liability

To the extent the law allows, we are not liable for indirect or consequential losses, for lost profits, revenue or data, or for fines and claims that arise from your messages or your compliance. Our total liability for any claim about the service is limited to the fees you paid us for the service in the 12 months before the claim.

Nothing in these terms limits liability that the law does not allow to be limited.

10.Ending the service

You can stop using BlastWiz at any time, subject to your order. We can suspend or end the service with notice if you break these terms or do not pay, and at once if we have to in order to follow the law or protect the service or other people.

When the service ends, you can ask us to delete your company's data by writing to [email protected]. The privacy policy explains what happens to stored information.

11.Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page. If a change is significant, we will tell customers before it takes effect. Using BlastWiz after a change means you accept the updated terms.
